All delivery prices quoted are for a driveway delivery, which is defined as a single dump on paved, gravel and/or dirt roads that are in safely passable condition for the weight and size requirements of the delivery vehicle.
Black Gold quotes driveway deliveries for your protection as well as ours. Due to their weight, delivery vehicles can cause severe damage when they proceed off a solid road surface. For example, they can leave deep ruts, damage buried septic tanks, gas & water lines, sleuce pipes, leach fields, etc., or become stuck which could damage the vehicle and result in you being charged for towing and repair of the delivery truck and the loss of additional deliveries which were scheduled to be made that day.
If the purchaser, or their agent, requests that the delivery truck driver do multiple dumps or proceed off the paved, gravel or dirt road as outlined above each of the following will apply:
- An additional charge may be imposed. The charge will be discussed with you prior to proceeding further.
- The purchaser agrees to assume all costs associated with loss of deliveries, truck repairs, and/or towing the delivery truck howsoever arising from or incurred because of deviating from the driveway delivery as quoted above.
- Towing charges are extremely expensive and the purchaser is liable for any scheduled deliveries that are unable to be performed as scheduled. Costs can easily exceed $1,000. In short, although we do not want to have to pass these charges along to you, we are a small company and cannot afford to absorb them.
- The purchaser agrees that the driver, trucking company and associates thereof shall not be liable for any property damage or for any personal injury, including death, sustained or suffered by any person, firm, entity, or corporation in connection with the dump.
- The purchaser agrees to assume all risk and liability for, and agrees to indemnify, save and hold driver, trucking company and associates thereof from all claims and liens, all loss of damage, claims, penalties, liability and expenses, including attorney’s fees, howsoever arising from or incurred because of deviating from the driveway delivery as quoted above.
In light of these facts, it is generally more cost-effective and safer to rent equipment such as a tractor, power wheelbarrow and/or Bobcat to move the product to the area you will be using it, than to risk the damage to your property, the delivery truck, etc. that can result from having our trucks go off a hard-road surface.
